Chinese State Owned Enterprises - Privileges or Immunities?
The question of whether Chinese state owned enterprises have special privileges and immunities have been troubling legal advisors. In the recent decision of TNB Fuel Services SDN BHD v China National Coal Group Corporation, the question of whether an SOE enjoys crown immunity is looked at. The speaker will examine the analysis of the case and also clarify the confusion pertaining to State immunity and crown immunity, and also the difference between a state owned enterprises and an institutional organization in China.
