Courts and Arbitration: Competitors or Partners?
There have been divergent views as to how the relationship between judicial courts and arbitral panels should be perceived. One could argue that those avenues of dispute settlement belong to two competitive realms, while another could argue that the judicial and arbitral processes actually complement each other in the pursuit of justice.
From the lens of the New South Wales' Court of Appeal President, the talk will address, amongst others, the general statutory powers and functions of courts that may be exercised to aid arbitral proceedings. This talk is particularly befitting for both students and practioners who are eager to obtain a further understanding of the vital role that courts play in commercial arbitration.
