Over the years, China has been a key trade partner of ASEAN countries, including Malaysia. The Belt & Road Initiative (BRI) has garnered attention worldwide as an ambitious trade and investment plan. With over 100 bilateral treaties between China and countries along the BRI, it is undeniable that this industry aims to break down the legal barriers in seizing opportunities along with the route and the alternative dispute resolution (ADR) mechanism will play a pivotal role when disputes arise.
However, as COVID-19 spreads, BRI related projects are likely to alter with respect to timelines, investments and other contractual factors, and will directly impact stakeholders and cause disputes.
