The Malaysian Institute of Arbitrators (MIArb) and the Kuala Lumpur Regional Centre for Arbitration (KLRCA) jointly presents an afternoon talk this coming 19th of April 2o16 on, “Finality to Awards of an International Arbitration seated in Malaysia – Arbitrators Beware!”.
Brief Synopsis
Arbitral Awards are intended to be final and binding. Malaysia in adopting the UNCITRAL Model Law has provided for limited circumstances where the Arbitral Awards may be challenged. These avenues for challenge are statutorily provided for under the Malaysian Arbitration Act 2005. This talk will specifically discuss the provisions and the leading cases where Arbitral Awards were set aside under these limited circumstances.
